Terms of service

These terms apply to Kairos, a free personal desktop app for charting, backtesting and keeping a trading journal, and to its sync service. Kairos is provided by Max Power Studio (operator: Max Cabrera, ABN 31 362 180 362). By using Kairos you agree to these terms.

Free, provided as-is

Kairos is free. It is provided "as is" and "as available", without warranties of any kind, to the extent permitted by law. We do not promise that it will be error-free, always available or fit for any particular purpose.

Not financial advice; no trading

Nothing in Kairos is financial, investment or trading advice. Kairos does not connect to brokers or exchanges to place orders and does not execute trades; any trading in the app is simulated or backtested only. You are solely responsible for your own trading decisions and for any gains or losses.

Market data

Market data shown in Kairos comes from third parties (for example Binance). It may be delayed, incomplete or wrong. You must follow those providers' own terms of use.

Sign-in and sync

Google sign-in is used only to identify you so that your data is kept separate from other users'. The sync service stores only your own app settings, layouts, drawings and journal. How we handle that data is described in our Privacy policy.

Acceptable use

Do not abuse the sync service (for example by overloading it, storing unrelated content, or trying to access other users' data), and do not reverse engineer, probe or otherwise attempt to attack or disrupt it.

Changes to the service

We may change, suspend or end Kairos or the sync service at any time. We will make a best effort to give notice beforehand.

Liability

To the maximum extent allowed by law, Max Power Studio and Max Cabrera are not liable for any loss or damage arising from your use of Kairos, including trading losses, lost data or lost profits. Nothing in these terms excludes, restricts or modifies any rights you have under the Australian Consumer Law or other laws that cannot be excluded.

Changes to these terms

We may update these terms. The updated version will be posted on this page with a new effective date. Continuing to use Kairos after that means you accept the updated terms.

Governing law

These terms are governed by the laws of New South Wales, Australia.
